The repercussion of the Acadêmicos de Niterói parade, which took to the avenue a plot centered on the trajectory of President Luiz Inácio Lula da Silva (PT), quickly went beyond the cultural field and migrated to the legal dispute.
According to CNNopposition parties and parliamentarians structure an offensive with at least 12 initiatives to contest the presentation, distributed between the Electoral Court, Public Ministry and control bodies.
The measures focus on four main axes. The first involves the accusation of early election propaganda. The opponents’ assessment is that the plot and elements of the parade would have promoted Lula outside the period allowed by legislation. By law, demonstrations with an explicit request to vote are prohibited before July of the election year, but the characterization of irregularity depends on a case-by-case analysis.

Another front looks at what they classify as abuse of political and economic power. The Partido Novo has already informed that it intends to request the president’s ineligibility as soon as there is an eventual registration of candidacy, under the argument that public resources would have been used to favor his image in a pre-election context.
The PL, in turn, announced that it should join with electoral judicial investigation action. The acronym maintains that there were mentions of the ballot box number, exaltation of the government and direct criticism of opponents, which, in its reading, would constitute a misuse of purpose. Party parliamentarians also indicated that they intend to ask the Superior Electoral Court to opening school accounts to determine the origin of resources and possible participation of businesspeople with contracts with the federal government.
There are still questions outside the strictly electoral field. Senators and deputies filed representations with the Attorney General’s Office and the TSE alleging religious discriminationdue to a wing that portrayed evangelicals. Some parliamentarians cite possible violation of the Penal Code due to public mockery motivated by belief.

The parade
The parade, entitled “From the top of the mulungu comes hope: Lula, the worker of Brazil”, presented episodes of the president’s political trajectory, from his childhood in the Northeast until his arrival at the Palácio do Planalto. The president attended the presentation of the area reserved for authorities, alongside the mayor of Rio, Eduardo Paes (PSD), ministers and allies.
In response to criticism, the PT maintains that the parade falls within the field of artistic and cultural freedom guaranteed by the Constitution. The party claims that it did not participate in the conception of the presentation, did not finance the event and instructed its members to observe the rules applicable to the pre-election period.
The party also argues that there was no explicit request for votes, which would rule out the characterization of advance propaganda.
