President of the Senate rejects request to annul Lulinha’s breach of confidentiality

The president of the Senate, Davi Alcolumbre (União-AP), refused, this Tuesday (3), a request to annul the breach of banking and tax secrecy by Fábio Luís Lula da Silva, son of president Luiz Inácio Lula da Silva, known as Lulinha.

The breach of confidentiality was approved by the INSS CPMI on Wednesday (26) by a close vote. The request came from parliamentarians from the government wing, who accused an alleged violation of the rules of procedure during the vote.

In his decision, Alcolumbre consulted the Senate’s lawyers on the matter and concluded that the alleged violation “does not appear to be evident and unequivocal”.

What motivated the distrust in voting

The requests for annulment were motivated by the result of the symbolic vote, carried out to determine whether or not to approve the breach of confidentiality. In this case, opposing parliamentarians must stand up while those who oppose must remain seated.

In a document sent to Alcolumbre, parliamentarians state that the requests were, in practice, rejected by 14 votes against, in contrast to the seven counted by the presidency at the time. Even so, the president of the CPI, senator Carlos Viana (Podemos-MG), declared the agenda approved.

Viana stated that only seven of those who spoke at the session were full members of the commission and, therefore, would have valid votes, the others would be substitutes.

The authors of the appeal also maintain that, moments before the symbolic vote, the electronic panel registered 18 votes in favor of the block vote and 12 against. The government supported block voting as a strategy to try to reject all 87 applications at once. The opposition defended the individual analysis of each item.

For the government supporters, as there was no substantial change in the composition of the commission between the nominal and symbolic votes, there would be no “arithmetic or political plausibility” for such an abrupt reversal of the result.

In the request, the parliamentarians requested not only the immediate suspension of the effects of the vote, but also the annulment of the deliberation that declared the 87 requests approved, with a new vote to be held.
