A federal court in Florida (USA) ordered the American government this Wednesday (5), after holding a hearing, to present in a full and transparent manner data relating to the former presidential advisor’s entry records into the country at the end of 2022.
Martins is suing the United States Department of Homeland Security and the immigration service (CBP), alleging that the entry records are fraudulent and that he did not travel to the US during the period with then-president Jair Bolsonaro.
This supposed trip was used as an argument by minister Alexandre de Moraes (STF) to order his preventive arrest in 2024, citing the risk of escape.
During the hearing, federal judge Gregory Presnell analyzed the US government’s request to close the case. The court, however, decided to postpone any decision and ordered new measures, in response to requests from Martins’ defense.
The judge ordered the government to present full, unredacted versions of documents that had been delivered with sections hidden, so that they can be examined.
At the hearing, lawyers for the American government admitted that the entry records “should not have been there”, leading the court to further investigate the origin of the information.
Presnell also ordered broader searches for documents and messages that could explain how the record was created and who participated in the process.
The magistrate also recognized the seriousness of the case and indicated orally that Martins has the right to know the information related to the migration record.
Martins is currently imprisoned in Paraná, after being convicted by the Federal Supreme Court in another case, that of the coup plot. He is serving a preventive sentence, until all his appeals are judged.
