Defense claims that management of the Brasília Federal Penitentiary imposed restrictions on meetings: scheduling for the following week and audio and video monitoring
The defense of Daniel Vorcaro, owner of Banco Master, called the Federal Supreme Court (STF) to ask that the visits from their lawyers in prison are not recorded in audio and video. The request was filed last Friday (6) and aims to guarantee the “full exercise of the right of defense” during the period in which he is detained at the Federal Penitentiary of Brasília.
According to lawyers, the prison management imposed a series of restrictions on meetings. In addition to informing that the visits could not take place immediately — requiring an appointment for the following week —, the prison unit announced that the conversations would be fully monitored by audio and video. The penitentiary also prohibited entry with paper and pen.
In the document sent to the STF, the defense asks the Court to guarantee regular visits without any type of recording or listening. The legal team also requests the authorization to bring printed copies of the process and take notes during conversations with the customer. Lawyers emphasize that these conditions are rights provided for in the Law Statute and the Criminal Execution Law.
The request also highlights that confidential communication between the lawyer and his client is an “essential guarantee for the right to defense”. Because of this, the legal team states that, if the Federal Penitentiary of Brasília cannot ensure compliance with these rules, Vorcaro must be transferred to another prison in the Federal District that can respect these legal guarantees.
