The minister responded to a request made by Lima’s defense, which cited the guarantee provided for in the Federal Constitution against the self-incrimination of those under investigation.

Mendonça also mentioned that the STF declared the incompatibility of the coercive conduct of those under investigation for interrogations, based on the right to non-incrimination and the principle of human dignity.

With Mendonça’s decision, it was up to Lima to appear in Congress. He could choose to remain silent, that is, he could not answer questions directed at him. The banker would also not be subject to the obligation to tell the truth.

The president of the CPI chose to cancel the meeting and regretted it because, according to him, Lima had a series of information to give to the group and “ended up having the benefit and privilege of not attending to give answers”.

“I have an agenda this Wednesday with minister André Mendonça. I will convey to him our desire for this position to be reviewed republicanly, for the work of Congress to be respected and for us to have a rebalance between the powers”, he stated.

He also stated that monocratic decisions delay and interfere in the work of the group, which has the prerogative in legislation to investigate within parliament.

Lima was arrested on November 17, in Operation Compliance Zero, which investigates the Master. The executive is at home, with an electronic ankle bracelet.

Suspicions of fraud in Master’s payroll loan portfolios, a business linked to Lima, raised an alert at the BC in March last year, according to BC documents and court decisions.

The businessman obtained control of Banco Voiter, formerly Indusval, a financial institution that ended 2024 with R$7.5 billion in assets and which had been controlled by Master since February 2024.

Under Lima’s command, the name of the institution changed to Banco Pleno, which focused on the corporate segment and was liquidated last month.

The starting point of the investigations that culminated in the arrests was in the first months of 2025.
