The president of the CPI of ,, made an appeal to the minister , of the (Supreme Federal Court), to be able to hear Daniel Vorcaro, owner of Banco Master. The senator’s complaint is in relation to the habeas corpus presented by the defenses of those involved in the case to free them from their presence in Congress.
The senator told journalists about the request made to the case’s rapporteur in court after a hearing in his office, this Wednesday (11).
“For us, it is a matter of honor for him to appear at the CPMI. He will be treated as an ordinary person, like everyone else was. But if there is no review of the habeas corpus, it is unlikely that he will have to give explanations or appear before our commission, which worries us greatly due to the need for the report to advance the issues of payroll loans and the financial system”, he said.
According to Viana, the minister responded that he will think about the case, especially that of the former banker.
“The minister made it very clear to us that he will review it. Especially in the case of Daniel Vorcaro, he will forward our appeal to the class for a vote for a collective decision,” said the senator.
Even so, Viana complained about the court’s monocratic decisions and what he called an imbalance between the Powers.
“A very courteous visit, but a visit that, unfortunately, does not advance in the sense that I have been talking about the imbalance between the Powers in our country. Minister Flávio Dino’s decision, which in my opinion is totally political, there is no basis for it to be taken within the Constitution, gets in the way and delays the Commission”, he said.
Carlos Viana made reference to Dino’s injunction that suspended last Thursday (5) the breach of banking and tax secrecy of all those listed by the mixed CPI, including Fabio Luis Lula da Silva, the president’s son.
According to him, in the next session of the commission, parliamentarians should no longer consider requests for breaches of confidentiality. “There is great legal uncertainty. What is the way to vote? Is every parliamentarian making a comment? Are there two parliamentarians on each side?”
The senator also spoke again of appealing to the court if the president of , (-AP), does not support the group’s request for an extension.
Since the end of February, he claims to have submitted the application with a sufficient number of parliamentarians, meeting the regulatory requirements, for its renewal, but that Alcolumbre has avoided it.
Now, he discussed the issue with Mendonça. According to him, the document should be filed this week with the request to President Luiz Edson Fachin to distribute the request to the rapporteur of the Master case.
Regarding data leaks from the investigation, the president of the CPI exempted the commission from “official responsibility”. This is because, according to him, the collegiate does not have most of the documents that were released, in addition to having the institutional responsibility for safeguarding the material.
On Monday (9), the president of the commission said that those responsible for breaches of confidentiality and other information in the investigations “did good for the country”.
Despite this, Viana stated that it was not possible to say that the leaks happened by the commission, that the collegiate did not disclose anything and that the presidency did not sign the release of the data.
“[Os vazadores] They did good because these leaks are of interest to the entire population. Now, as president of the CPI, I am very clear, and so is the rapporteur, that we do not have any type of information that has been publicized given the secrecy that has reached us”, he said.
Viana also stated that the data was handled by many people.
Last week, Vorcaro’s defense asked the STF minister to open an investigation to determine the origin of data taken from cell phones seized during the investigations against him.
According to the lawyers, the mirroring of data from the devices was handed over to the defense only on March 3rd. The HD with the material was, according to the former banker’s lawyers, sealed in the presence of police authorities, lawyers and a notary to preserve the confidentiality of the information.
In response, Mendonça responded to the defense’s request and opened the investigation.
