CRITICISM OF COURTS

When talking about the performance of the courts in the face of the waves of hatred she suffered, Erika declared that the Judiciary bodies do not adequately comply with the decision of the which equated transphobia and LGBTphobia with the crime of racism.

“There is omission, and there is even, I think, often a certain disregard for a determination made by the Federal Supreme Court. It was important that the Federal Supreme Court did not allow some bodies of the Judiciary to mock its decision”these.

Erika reported that, when calling the Judiciary, the expectation is that what was determined by the STF will be complied with, but that, in most cases, the courts dismiss cases related to cases of LGBTphobia, arguing the absence of intent or intention to attack the victim. This practice makes it difficult to effectively apply the rights achieved by the LGBTQIA+ population.

The congresswoman declared that she is not referring to cases that could have another interpretation, but to serious and openly transphobic situations, in which there is great difficulty in applying the legislation.

The deputy also compared the situation with crimes of racism, in which there is also difficulty in applying the law and attempts to classify cases as insults.

“We still live in a deeply racist society, in a deeply LGBTphobic society, and this reverberates. It reverberates in the Legislature, but it also reverberates in the courts”said Hilton.
