The Chamber of Deputies on Tuesday (April 7, 2026) drafted a bill that establishes minimum rules for the government transition process in the period between the final result of the election and the date of inauguration. Authored by the deputy (Psol-RJ), the proposal will be sent to the Constitution, Justice and Citizenship Committee to prepare the final wording.
According to the text, it becomes the duty of the outgoing administration to facilitate the administrative transition to the new ruler, under penalty of liability.
According to the proposal, it will be up to the Chief Executive to allow and facilitate access by elected administrators or their legitimately constituted representatives to material facilities and all administrative information pertinent to the management that is ending, including that relating to the provision of third-party services.
The text also determines the obligation to provide technical and administrative support necessary for the work of the transition team.
If measures are not taken, the text establishes applicable administrative and legal sanctions and a fine, in addition to the obligation to repair the damage caused.
Among other points, the project considers deliberately withholding information as aggravating circumstances; render databases or IT equipment unusable or damage material or immaterial public property with the aim of hindering the transition, even if practiced from the beginning of the electoral period until the end of the transition.
Incurring in these circumstances results in a 1/3 increase in the penalty. The same applies to cases of intimidation of a public servant or agent into non-compliance with the project rules, without prejudice to other applicable administrative, civil or criminal sanctions; and cause irreparable or irrecoverable damage.
For Chico Alencar, the project will guarantee transition processes with reliable data and teams, with technical competence and transparency. According to him, the transition must take the public interest into account. “I would call this the law against bad election losers. Knowing how to lose is as important as knowing how to win”these.
The text grants a period of 72 hours for the formation of the transition team, in equal composition. The deadline will run from the announcement of the election results.
The members of the transition team will not be remunerated, except if they are public servants, who will be guaranteed the remuneration and benefits they already received.
