Senators contest rejection of the CPI on Organized Crime report

Senators Magno Malta (PL), Eduardo Girão (Novo) and Marcos do Val (Podemos) filed an objection this Saturday (18) to contest the final vote of the CPI on Organized Crime at the Federal Senate, alleging that changes made to the composition of the commission, shortly before the vote, altered the result. “On that date, the replacements that substantially altered the internal structure of the CPI, with a direct impact on its deliberative conformation”, says the document.

According to the appeal, the parliamentarians who followed the entire investigation were replaced by others who did not participate in the instruction phase, which would have distorted the correlation of forces and compromised the legitimacy of the deliberation.

The authors claim that there was a violation of the principle of proportionality and improper use of regulatory prerogatives. That’s why, call for the vote to be annulled and the committee to be reconstituted so that a new decision is taken on a regular basis.

Finally, the document requested:

  • The receipt and regular processing of this objection, with its assessment within the scope of this General Secretariat of the Board, given the constitutional and regulatory relevance of the matter;
  • The recognition of the invalidity of the replacements promoted on 04/14/2026, as they constitute a violation of material proportionality, misuse of purpose, fraud in the internal legislative process and abuse of parliamentary power, in the terms set out;
  • The declaration of nullity of the decision that rejected the final report of the CPI on Organized Crime, as it was issued by a panel substantially different from the one that carried out the investigation of the work;
  • The restoration of the composition of the committee prior to the aforementioned replacements, with the consequent renewal of the final deliberation under conditions of constitutional and regulatory regularity;

Report rejection

The Senate Parliamentary Commission of Inquiry (CPI) on Organized Crime presented by senator Alessandro Vieira (MDB-SE). There were six votes against and four in favor of the text that called for impeachment of the ministers of the Federal Supreme Court (STF) Alexandre de Moraes, Dias Toffoli and Gilmar Mendes.

The rejection of the report came after the head of the Executive, Luiz Inácio Lula da Silva (PT), and the president of the Senate, Davi Alcolumbre (União Brasil-AP). The articulation resulted in the exchange of senators Sergio Moro (PL-PR) and Marcos do Val (Avante-ES) by Teresa Leitão (PT-PE) and Beto Faro (PT-PA). The CPI was formed by 11 sitting parliamentarians, of whom ten voted, and seven substitutes.

Organized Crime CPI

Installed on November 4, 2025, the CPI investigated the activities, expansion and functioning of criminal organizations in Brazilian territory, especially factions and militias. The collegiate investigated the modus operandi, operations in each region and their structures in order to identify suitable solutions to combat, mainly through improvement of current legislation.
