One of the ways to deviate from a point under question is to propose looking at the problem through a magnified lens. And, in this aspect, the proponent generally has an advantage. After all, why not see the whole instead of focusing on the part, right? In theory, it makes perfect sense.
In practice, however, there is a risk that the breadth of the debate will lead to dispersion and a loss of concentration on the main issue, which becomes diluted in the whirlwind of suggestions. One, as proposed by the STF minister, sounds consistent with the demands for corrections in the Justice system. There are many flaws and distortions. The topic is relevant.
But the current crisis that is plaguing the Federal Supreme Court does not result from this situation. It concerns improper conduct on the part of supreme magistrates and the fact that guardians of the Constitution behave as if they were untouchable beings, beyond the reach of the law.
They can, and should, be. They are not exclusive, as Flávio Dino suggested in his article, when he made his proposal a counterpoint to “certain superficial discourses about , seen as a philosopher’s stone”. Direct reference to statements by the president of , , and the minister about the need for judges to be more restrained in their statements.
To show contempt, Fachin sought . He stated that he received the “timely reflection” with “applause and support”. The hostility, however, was marked by Dino’s attempt to demote his colleagues to the level of demagogues, as they believed that the recovery of the Supreme Court’s image could begin with the creation of an internal code of conduct.
It would be a signal to public opinion from which the debate on broader and deeper changes could then evolve. The proposals for general reform and the tired suggestion of establishing pacts between the Powers seem ambitious, but they sound more like the idea of changing to keep everything as it is.
