STF forms majority to maintain arrest of former BRB president

With the vote of Minister Nunes Marques, the vote is 3 to 0; the opinion of Minister Gilmar Mendes still remains

The Federal Supreme Court (STF) formed a majority this Friday (24) to maintain preventive detention of the former president of BRB Paulo Henrique Costa and lawyer Daniel Monteiro, investigated in the Banco Master case. With 3 votes, from ministers André Mendonça, Luiz Fux and Kássio Nunes Marques, it was decided to maintain the prisons.

On Wednesday (22) the Fux had already accompanied the rapporteur, André Mendonça, and voted to maintain the preventive detention of former BRB president Paulo Henrique Costa. The trial began on Wednesday (22) in the Second Panel of the Court and takes place in a virtual session. Magistrates have until 11:59 pm this Friday (24) to register the votes.

The Second Panel of the STF is composed of ministers Kássio Nunes Marques, Gilmar Mendes and Dias Toffoli, who declared himself a suspect to participate in the trial amid connections with Banco Master.

There still remains opinion of minister Gilmar Mendes.

Arrested by the PF

Paulo Henrique Costa was arrested on April 16thduring the 4th phase of Operation Compliance Zero, carried out by the Federal Police (PF). During the afternoon, he left the PF Superintendency and was transferred to the Papuda Penitentiary Complex.

The PF informed Minister Mendonça that it had identified a alleged bribery flow destined for Paulo Henrique Costa in the negotiation of the sale of Banco Master to BRBwhich would have been made possible through the purchase of properties. Based on this information, the magistrate ordered Costa’s preventive detention.

The former president of BRB is investigated for his role in the attempted acquisition of Banco Master by BRB, in addition to the purchase of fraudulent wallets offered by Daniel Vorcaro’s bank.

The executive assumed the presidency of BRB in 2019, appointed by the then governor of the Federal District, Ibaneis Rocha (MDB), and led the attempt to acquire Banco Master by the institution. He was removed from office in November, following a court decision as part of the first phase of the operation.

In a statement, the former governor’s defense said that Ibaneis “did not monitor, did not pressure nor did he have any interference in operations carried out by the aforementioned financial institutions”.

He also stated that the conversation with Daniel Vorcaro corroborates what was pointed out by the defense. He also says that, if he had direct participation in the operations, it would be unnecessary to prepare a technical note for himself.

Paulo Henrique Costa, was transferred to the Papuda Penitentiary Complex after being arrested this Thursday (16) in the 4th phase of Operation Compliance Zero. He left the Federal Police Superintendency in the afternoon and headed to Papuda.
