Congress decides whether to maintain Lula’s veto on Dosimetry PL this Thursday

O National Congress should analyze this Thursday (30) the presidential veto to the project that deals with the dosimetry of sentences applied to those convicted of attempted coup d’état and for involvement in the coup acts of January 8, 2023. The decision may change the prison time and regime progression rules in these cases.

The vetoed text (PL 2,162/2023) establishes criteria for calculating penalties, which takes into account the seriousness of the crime, the antecedents and circumstances. The proposal, approved by Congress at the end of 2025, provides for the possibility of reducing the sentences of those involved in the depredation of the headquarters of the Three Powers and could benefit those convicted, investigated and defendants in related processes.

By fully vetoing the matter, President Luiz Inácio Lula da Silva (PT) argued that the reduction of the criminal response to crimes against the Democratic Rule of Law could encourage new infractions and represent a setback in the country’s redemocratization process. According to the justification sent to Congress, the project could also compromise constitutional principles such as proportionality, equality and impersonality.

The veto message also raises questions about the processing of the proposal. According to the government, as there were changes of merit in the Chamber of Deputies, the text should have returned to the Federal Senate before proceeding for presidential sanction.
