Being on the IRS public list of debtors is not a scenario exclusive to large companies or extreme cases. Any taxpayer who accumulates tax debts above a certain amount and does not pay them off may end up on this record, with effects that go far beyond a simple administrative note. This is an official list, accessible to everyone, containing taxpayers with tax situations to be regularized and who have already passed various stages of the legal process.
According to Ekonomista, a website specialized in economics, which cites the Federal and Customs Revenue, this list brings together individuals and legal entities that did not fulfill their tax obligations within the legal deadline, did not present guarantees or resort to the available mechanisms to suspend the executive process.
What is, after all, the list of debtors
Popularly known as the “tax black list”, this public relationship exists to provide transparency to tax enforcement processes. It only shows debts that have already passed the voluntary collection phase and have entered into tax foreclosure, in amounts exceeding R$7,500.
Small delays or isolated fines are not at stake. Only taxpayers whose debt is active, payable and have not been the subject of an agreement, guarantee or request for payment waiver are included. The objective is to make public a situation that, from a legal point of view, has already stabilized.
Who can be included and under what conditions
For a name to be announced, several criteria must be met simultaneously. The debt must exceed 7,500 euros, the voluntary payment period must be exhausted and the process must be in tax execution. Additionally, there may be no approved payment plan or guarantee provided.
This explains why many taxpayers with debts to the State never appear on this list. Simply negotiating an installment plan or submitting a timely complaint prevents advertising.
How the information is organized
The list does not reveal exact values. Taxpayers are distributed into debt bands, which allows us to understand the order of magnitude of the amount in question without exposing the specific number. The ranges range from amounts between 7,500 and 25,000 euros to amounts exceeding one million.
The most recent data indicates that tens of thousands of taxpayers are on this register, with the majority being in the lowest brackets, which suggests situations of accumulated default and not necessarily large fortunes in debt.
Where to consult and how to confirm your situation
Querying the public list is simple and does not require authentication. On the Finance Portal, simply access the area dedicated to debtor advertising, choose the type of taxpayer and the desired level, and download the available file.
For those who want to confirm their own tax situation, the most direct route is through the reserved area of the same portal. After authentication, it is possible to check whether there are debts in voluntary collection, tax enforcement proceedings or other pending issues that could have consequences.
What happens while the name is there
Presence on this list is not just symbolic. It can result in the withholding of IRS refunds, the loss of tax benefits, the impossibility of concluding contracts with the State and the continuation of the process of seizing assets or income. The debt, however, continues to generate late payment interest, increasing the total missing amount.
How to unsubscribe
There are essentially two ways. The most direct involves full payment of the debt, which leads to the removal of the name within a short period of time after confirmation of payment. The alternative is to request payment in installments, as long as the plan is accepted by the Federal Revenue Service. In some cases, the presentation of guarantees allows the applicable interest to be reduced.
There is also the possibility of payment in payment, through the delivery of goods, a less frequent solution, but provided for by law.
What if there is an error?
Administrative errors may occur. When the debt has already been paid, is time-barred or there is a challenge process, the taxpayer can request immediate exclusion from the list through the available legal mechanisms, such as the graceful complaint, to be presented within the stipulated deadlines.
According to the Tax and Customs Authority, when the tax situation is regularized or it is found that the inclusion was undue, the name is removed from the list after internal validation, allowing the taxpayer to prove again, if necessary, through a certificate, that he has no debts to the State.
