In a virtual trial, held on the 15th, the (National Council of Justice) rejected an appeal by judge Carlos Henrique Abrão, from the (Court of Justice of ) against the precautionary removal from office for 180 days. The was applied in March.
Abrão was accused of altering trial minutes after the announcement of the result and the end of the session, on December 2, 2020, when he presided over the 14th Chamber of Private Law.
The judge filed declaratory embargoes. This is a resource used to clarify obscurities, eliminate contradictions, make up for omissions or correct material errors. Abrão intended to obtain the nullity of the process.
12 lawyers were registered for the disciplinary review.
In both sessions, the board unanimously followed rapporteur Daiane Lira. The CNJ annulled the archiving of two cases. The rapporteur understood that the censorship applied by the São Paulo court contradicted the evidence in the case and the seriousness of the facts.
“It is not a bureaucratic error nor mere negligence. In fact, it is misconduct that affects the essence of legal security”, he stated in his vote in March.
The judge alleged, throughout the process, a lack of transparency in judicial decisions.
His dismissal, in March, was broadcast on TV Justiça. The CNJ did not make the appeal judgment available for public consultation.
On the CNJ website, it is stated that the virtual plenary trials are public.

. The rapporteur, counselor Daiane Lira, did not lift the secrecy.”
The counselors (who presided over the trial), Mauro Campbell Marques (national inspector), Jaceguara Dantas, Fabio Esteves, Silvio Amorim, João Paulo Schoucair, Ulisses Rabaneda, Marcello Terto and Rodrigo Badaró voted with the rapporteur.
When it was reported that he was being disciplined under secrecy, given the suspicion of offenses and intimidation against people with whom Abrão had a business relationship, the judge claimed that it was “yet another conspiracy” to remove him from his career.
The case included documented information that the then president of the Private Law Section, judge Dimas Rubens Fonseca, received from judges Régis Rodrigues Bonvicino and Ligia Bisogni.
Bonvicino, who died in July 2025, refused to sign the ruling amended by Abrão. He reported having been the target of pressure from Abrão.
Members of the 14th Private Law Chamber spoke to Abrão. They stated that the magistrate “at no time exceeded his duties”.
Abrão appealed to the Inter-American Commission on Human Rights to try to reverse the removal.
Lawyer criticizes inspector
On May 8, lawyer José Cretella Neto, one of Abrão’s defenders, published in this column, as a reader’s letter, criticisms of the national justice inspectorate.
Cretella Neto cited the judge, by 25 votes to 0, in the Special Body of the TJ-SP. And he added: “Strangely, the CNJ reopened the case. Unfortunately, Minister Mauro Campbell is persecuting him. That’s the truth.”
The lawyer also said: “Two representations I made against venal judges of the first instance in São Paulo were summarily archived by him. It doesn’t seem to me that he has the competence or exemption to judge.”
Abrão’s defense used the same space where I always recorded the magistrate’s allegations and .
In the most recent provocation to the columnist, Abrão stated: “I am sending all your writings to Alexandre de Moraes, our student, so that he can be included in the fakes investigation.”
Previously, the judge had written: “The murder of reputation and deconstruction has its days numbered; our lawyers will file criminal complaints against you, slander, defamation and insult in order to spend good years in jail.”
