The (National Council of Justice) unanimously approved this Tuesday (26), a resolution that creates a single paycheck for magistrates, with the aim of standardizing items and prohibiting parallel payrolls.
The decision comes two months after that of the (Federal Supreme Court) on . The constitutional ceiling remains R$46,366, but additional payments may exceed this amount, depending on the case. The court established that members of the Judiciary and the Court may receive compensation amounts of up to 70% of the civil servants’ salary.
These funds authorized by the thesis will be included in the single paycheck. These include daily allowances, subsistence allowances, remuneration for classes, bonuses, vacation compensation and retroactive amounts pending payment. The resolution establishes a 60-day deadline for the courts to adapt to the new rules.
The objective of the resolution is to reduce the difficulty in accessing information about the remuneration of judges and judges. Sometimes, courts separate part of the additional payments received by magistrates, which harms transparency. This is what happens in cases where retroactive payments, one of the additional payments that most inflate judges’ salaries, are segregated from the common payroll.
“The practice of fragmenting payments into multiple paychecks and supplementary sheets makes it difficult to verify compliance with the remuneration ceiling. A single paycheck, therefore, is an imperative requirement for compliance with that constitutional command”, stated the president of the STF and CNJ, rapporteur of the act.
According to the decision, all information must be on a single payslip, which will be accessible on the magistrates’ remuneration portal and on the national functional liabilities portal, created in April by the CNJ.
Salary data for judges and judges must be sent to the CNJ by the 10th of each month.
In April, another joint resolution between the CNJ and the CNMP (National Council of the Public Prosecutor’s Office) aimed to comply with the Supreme Court’s decision, but, in practice, it opened a loophole to also create other types of benefits.
Among them is the early childhood and maternity protection bonus (aimed at members with children up to 6 years of age) and housing assistance.
