The decision was made by judge Guilherme Kirschner, from the 2nd Civil Court, and was published on the 20th, in an action proposed by the city hall.
When proposing the action, the city hall requested an audit of the campaign carried out by the entity, in which Geraldo Falcões would have received R$20 million.
In the action, the NGO argued that the municipality did not have the legitimacy to act on behalf of donors and victims, and that the funds raised would be of a private nature.
Kirschner, however, did not agree with the argument. He stated that he understood that the “collection of huge resources (in excess of R$ 20 million), under the public promise of repayment for the benefit of victims of public calamity that occurred in the municipality’s territory, with wide publicity in the media and social networks, attracted the trust of the community and subjected the managing entity to the duty of transparency before society and control bodies”.
When speaking out in the case, the Public Prosecutor’s Office also recognized the legitimacy of the city hall.
To the Panel, the NGO says that it maintains all action reports, accountability and independent auditing on its portal. It also states that, in relation to the 2023 #TamoJunto Litoral campaign, it was accountable throughout its implementation and maintained dialogue with the municipality.
“Transparency is a non-negotiable pillar for Gerando Falcões”, states the NGO. “Gerando Falcões maintains its dialogue stance, has formed partnerships with municipal bodies and will continue to ensure accountability, providing the competent bodies with all additional information that is necessary”, added the entity.
After the rains in February 2023, the city had 64 deaths and 4,000 people were left homeless and displaced.
