The man accused of breaking into a nutritionist’s apartment and trying to rape her in Barueri, in Greater São Paulo, he begged the judge not to remain in prison. The request, repeated at least four times, was made during the custody hearing.
The request from Wellington de Oliveira Santos, aged 37, was not answeredthe. The magistrate stated that the arrest was necessary “especially for the preservation of the victim”. The arrest in flagrante delicto was converted into preventive arrest.
Wellington tried to reverse the decision. “Don’t do that to me, doctor. I take care of my 74-year-old father. I’m not that dangerous. I was simply drunk. I beg you, I take care of my father and my son. I’m not that monster. I beg a vote of confidence.”
After repeated requests for release, the judge appeared impatient and asked a server to call the police station to remove Wellington from the room. The hearing lasted about eight minutes.
During the hearing, the Public Prosecutor’s Office stated that the accused already had a conviction for rape in 2005, in addition to having committed crimes of violence against women in 2025.
The Public Defender’s Office, in turn, stated that the merit would not be analyzed at that time, that the presumption of innocence prevailed and that Wellington was insufficient (he did not have the financial resources to cover the costs of legal proceedings).
According to the defense, the attempted rape could be classified as home invasion and sexual harassment in the criminal investigation phase.

During the hearing, the accused claimed that I didn’t know who I would find in the apartment. “I went up, I don’t even know how to use an elevator, I don’t even know how I got there. I didn’t know if there was a man, if there was a woman, I didn’t know. I could have had both there.”
The Civil Police seized the suspect’s cell phone to analyze messages, contacts and possible conversations that could clarify whether he monitored the nutritionist’s routine or whether other people participated.
The case was registered at the Women’s Defense Police Station (DDM) in Barueri as attempted rape, bodily harm and home invasion.
