Jaques Wagner’s defense asks the STF to cancel the search and seizure

The defense of senator Jaques Wagner (PT-BA) reported this Monday, 22, that he presented an appeal to the Federal Supreme Court (STF) asking for the annulment of the decision that authorized the search and seizure at the parliamentarian’s residence. According to lawyers, the measure was based on mistaken premises and presents “serious errors” that compromise its validity.

Last week, Wagner was the target of the ninth phase of Operation Compliance Zero, which investigates the links of former banker Daniel Vorcaro, from Banco Master, and the senator’s alleged participation in the scheme. The Federal Police suspect that Wagner received a property worth R$2.5 million and bribe payments totaling R$3.5 million, through a company linked to one of his family members.

In the appeal, the defense argues that the parliamentarian never acted in the National Congress to benefit Banco Master. As proof, he cites the only amendment presented by Wagner on the subject, within the scope of Provisional Measure 1106/2022, which provided for the limitation of interest and the expansion of consumer protection — “precisely the opposite of the bank’s interests”.

The lawyers also highlight that the senator took a stand against the so-called “Master Amendment”, presented by another parliamentarian during the processing of PEC 65/2023, which deals with the operational and financial autonomy of the Central Bank. According to the defense, all of the senator’s statements and actions on the subject are public and documented.

The resource also mentions a statement by the proposal’s rapporteur, senator Plínio Valério (PSDB-AM), who stated, in a note, that he had never been approached by Wagner to discuss the issue.

Regarding the cash found during the operation, the defense maintains that they have a legal and proven origin. “Part comes from publicly declared daily allowances paid by the Senate for missions abroad, and another part was acquired through official operations with a financial institution, with regular registration”, says the note sent to the press. “There is nothing to hide. The Federal Public Ministry itself had already considered the seizure of these assets premature”, he adds.
