According to the document presented for registration, Flávio must request the suspension of the fee and propose a “constructive and negotiated resolution of the issues identified in the research”. Leia a (PDF – 160 KB).
The senator must say that the tariff, “in practice, it would benefit the current government, whose conduct the investigation describes”while it would harm Brazilian exporters, North American importers, US consumers and the Brazilian opposition, “who is the main domestic victim of the conduct in question”.
According to the request, Flávio wants 5 minutes to give his statement. In the text, he mentioned that he recently met with the President of the USA, (Republican Party), with the Vice President, (Republican Party), and with the US Secretary of State, to discuss the matter.
The public hearing will be held on July 6. The legal deadline for defining and applying corrective measures against Brazil is July 15, 2026. The decision on whether to apply the tariff is up to Trump.
UNDERSTAND
The adoption of the new tariff on June 1 after the USTR (Office of the United States Trade Representative) concluded the section 301 investigation against Brazil. The measure was presented as a response to what the US government sees as unfair trade practices.
The USTR document lists topics such as Pix, digital trade, preferential tariffs, combating corruption, intellectual property protection, access to the ethanol market and illegal deforestation as targets for the investigation. One of the conclusions is that Brazil adopts public policies that favor Pix and place North American companies operating in the electronic payment services sector in a “unfair disadvantage”.
Some products, however, were spared the tariff. This is the case with meatfruits, minerals, coffee, tea, spices, cereals, seeds, oilseed fruits, industrial and medicinal plants, straw and fodder.
Brazilian aircraft and aircraft parts, rare earths, organic chemicals, pharmaceutical products and fertilizers were also exempt from the tariff.
The measure is part of Trump’s attempt to rebuild his tariff policy after legal defeats in the US. The North American government began using country-specific investigations to support new charges on imports. Section 301 requires consultations, hearings and individual verification before tariffs take effect.

The proposal was presented after an attempt at rapprochement between the president (PT) and Trump.
