Justice denies confidentiality of investigation into murder of player who made a faction sign in photo

The request for the process to be declared confidential was made by the defense of Isaias da Costa, one of those accused of the murder of 18-year-old football player Thiago Oseas Tavares, for making the V sign in a photograph, which was denied.

According to the defense lawyer, the request was justified due to the great repercussion of the case, which he classified as media, but the judge of the 1st Jury Court, Robson Aleixo, denied the request. The information was given by TV5 this Thursday (16).

In his decision, the judge said that the request is not supported by the elements present in the case file, especially considering that the publicity of procedural acts is a rule, in accordance with the principle of transparency enshrined in the Federal Constitution.

The judge also highlighted that for the imposition of secrecy, it is necessary to prove the effective need to protect the privacy of the parties or third parties, which has not been adequately demonstrated.

The decision also guarantees access to the records for all parties involved and interested parties.

Isaías da Costa, Francivaldo Barroso de Chaves, known as “Avocado” and Pablo Rodrigo Farias are defendants, in a second case, which investigates the murder of Thiago Tavares, aged 18.

The Santa Cruz do Acre player was executed in the early hours of April 31 last year, after being kidnapped from a party, in the Recanto dos Buritis neighborhood, and is one of the victims who was allegedly murdered because of a photo in which he appears making the V sign, for victory or peace, but which is confused with the sign of a criminal faction, where his killers are from the rival faction.

The other defendants, Darcifran de Moraes, Eduino Júnior Kauã Cristyan Almeida Nascimento and Andrey Borges, were sentenced to answer for the murder in a popular jury.
