Excessive processes make the judicial system ineffective, says president of the Brazil Europe Integration Forum

Brazilian justice received 35 million new cases in 2023, an increase of 9.5% compared to the previous year, according to the National Justice Council (CNJ).

The large number of lawsuits opened each year in Brazil has drawn the attention of experts to the impacts on the judicial system and the resolution of cases.

Vitalino Canas, president of the Brazil Europe Integration Forum (FIBE), told CNN that there is “excessive litigation” in Brazil, compared to other countries, surpassing the United States in some cases, for example.

According to Canas, this means that the judicial system lacks speed and effectiveness.

The expert warns that one of the reasons for this high number of cases is the practice of predatory or abusive litigation, when lawyers open thousands of actions on behalf of people who may not know they are being cited, or actions with identical sections, only being changed number and author, among other situations.

“This is a situation that contributes to this image of the slowness of Justice in Brazil, of ineffectiveness”, highlights Canas, explaining that the system is “clogged” with processes.

To discuss these problems and possible solutions, FIBE will hold on November 28th and 29th, at the Centro Cultural de Belém, in Lisbon, the Economic and Social Impacts of Mass Disputes Forum.

The president of FIBE highlighted to the CNN the importance of debating the subject, pointing out that several mechanisms can help mitigate abusive practices and speed up the analysis of processes.

“There are no miraculous solutions that can solve this overnight, but there are mechanisms that we will discuss in our forum that could allow us to mitigate this situation, free up courts and create conditions so that those who truly want justice can have justice faster” , he highlighted.

Canas explained to CNN that the forum will bring together personalities from different sectors, from the high level of the public sector to entities that have been affected by excessive litigation.

Among the participants will be Gilmar Mendes, minister of the Federal Supreme Court (STF), Bruno Dantas, president of the Federal Court of Auditors (TCU), and the Brazilian Federation of Banks (Febraban).
