The trial at the Federal Supreme Court (STF) of former president Jair Bolsonaro (PL) and others involved in the alleged coup attempt, which is being investigated by the Federal Police, could take place between March and April 2025, say Court sources .
If the Federal Police report is sent to the STF this week, minister and rapporteur Alexandre de Moraes must send it to the Attorney General’s Office the next day.
The PGR will then have 15 days to decide whether to archive, accept or request new measures.
This stage must be completed by mid-December, shortly before the judicial recess begins on the 20th.
It is likely, according to sources heard by the CNNthat immediately after the end of the recess, on 02/01/25, Alexandre de Moraes begins the next phase: hearing witnesses, final arguments and production of new evidence.
Once this phase is complete, the STF then activates the PGR to find out if there is any complement or response to the defenses’ demands.
Once this rite is complete, the case will be ready to be judged.
Criminal lawyers, heard by the CNNassess that it is more “feasible” for the trial to take place in June because the parties can request expertise.
Step by step
- PF sends report with the indictment to the STF
- STF sends report to PGR
- PGR complaint
- STF judges receipt of the complaint and must decide to open criminal proceedings
- Criminal action is instructed:
– deepening the investigation with the production of new evidence
– hearings with defense and prosecution witnesses
– final arguments of the parties - Criminal action goes to trial (conviction or acquittal)
