The minister, of the (Federal Supreme Court), disagreed with the rapporteur, in the case of (no party) to reduce the prison sentence imposed. The judge also found two of the crimes analyzed in the criminal action to be prescribed.
The former federal deputy is responsible for attacking the exercise of powers, homophobia, slander and incitement to crime.
For Zanin, the last two crimes can no longer be punished. The case report was received on June 27, 2022. As it has been more than two years and the sentences defined in each add up to less than two years, the crimes would be time-barred.
Furthermore, one of the mitigating factors cited by Zanin is Jefferson’s age, who turned 71 in June.
“The culpability and the circumstances, in turn, they proved to be very serious, as the criminal acts were carried out in a comprehensive and multiple manner”, said the minister.
While Moraes set a sentence of 9 years, 1 month and 5 days in prison, in addition to R$200,000 in collective moral damages, Zanin proposed 5 years, 2 months and 28 days in prison and followed up on the other sentences.
Moraes also defined that, until the process is concluded, Jefferson’s political rights are suspended. So far, he has been accompanied by Flávio Dino and Luís Roberto Barroso.
The court began judging the case in an open virtual session on Monday (9). Ministers have until this Friday (13) to cast their votes.
The criminal action was proposed by the (Attorney General’s Office) as a result of interviews in which Jefferson had encouraged the population to invade the Senate and “perform de facto acts” against senators and to blow up the building of the (Superior Electoral Court).
He was also denounced on charges of slander, for attributing the crime of malfeasance to the president of the Senate, and for homophobia, for saying that members of the LGBTQIA+ community represent the “moral demolition of the family”.
