Responsible for the defense of the former superintendent of the city hall of Antonio Carlos Pires Rebello, lawyer Luis Gustavo Janiszewski indicated that he must challenge the validity of those who needed to buy dinner invitations in support of the candidate (PSD).
The audios came to light in the press on October 1st, during the election campaign, and the alleged coercion of civil servants led to the dismissal of Rebello, who had a leadership position in the city hall and was not a civil servant. Since then, Rebello has not spoken publicly about the matter. Pimentel, current vice-mayor, was elected in the second round.
In an interview with the Panel this Tuesday (17), Janiszewski stated that his client did not use coercion, just “an informal invitation, without imposition”, and that the validity of the audios will be challenged.
“We have to question these supposed recordings leaked to the press. It is dangerous to take small excerpts of clandestinely recorded conversations to conclude something. We don’t know if they have legal validity”, says the lawyer, who represents the client in an electoral judicial investigation action .
“Every citizen, not just Rebello, cannot be intercepted without a court order. It is not a defense on the merits, but it is something that the defense will face,” he added.
After the episode, the city hall and Pimentel’s campaign told the press that it was an isolated act, that Rebello acted on his own, without orders from bosses or third parties. Rebello’s defense followed a similar line this Tuesday by repeating that “there was no order from authority, from top to bottom.”
“The background was to target Pimentel’s campaign. I even wonder if this recording was cut, pasted, modified,” said Janiszewski.
“What existed was a call for collaboration with the party, an informal conversation. There was no imposition. If an employee did not collaborate, there would not be any type of consequence. And the donation to the party was not linked to a position, no there was give and take”, he continued.
In the audios obtained by Sheet At the time, Rebello says he was given “a task” and “there’s no way not to do it.”
“There will be a dinner and everyone who can help with the dinner will need to do it. It’s not little, it’s not cheap. But what it will be like has already been determined. There’s no way to negotiate that,” said the then superintendent. He was referring to the September 3rd dinner at the Madalosso restaurant, organized by the state PSD and linked to Pimentel’s campaign.
In the audios, Rebello also reads a list with the names of employees who must contribute and announces the amounts that each one needs to pass on. He also advised that employees who had a bonus of the type FG5 or FG6 could not make “direct Pix”, suggesting that the transfer be made in the name of another person, the spouse, for example.
