Minister Gilmar Mendes, of the Federal Supreme Court (STF), ordered the closure of a Federal Police investigation that found omission of information in the statement involving the electoral campaign of federal deputy Aécio Neves (PSDB-MG), in 2014.
The procedure was under the responsibility of the Electoral Court in Minas Gerais. The Attorney General’s Office (PGR) initiated this investigation based on statements made by a cooperating defendant, Elon Gomes de Almeida, who cited hidden donations to candidates in the election in question.
As the suits were not related to the mandate he held at the time, as senator, the PGR declined the attribution and sent the case to the first instance.
Among the evidence highlighted was a report on financial transactions prepared by the Financial Activities Control Council (Coaf).
The defense claimed, in the process, that the confidential data was obtained without judicial authorization, before the investigation was formally launched. agreed.
“There is evidence, therefore, that investigative acts were carried out by an authority that did not have legal authority to carry them out – and that this irregular action produced evidence that, alongside non-specific and generic reports from the collaborator, are still used today by the PF as justification to continue with the investigation against the applicant”, he stated in the decision.
The minister also pointed out that the investigation has been open for five years, to investigate facts that allegedly occurred more than 10 years ago. Which, according to the minister, is an “unreasonable” deadline.
“For almost five years, therefore, the applicant has been investigated for acts allegedly carried out more than ten years ago, without the Federal Police having gathered evidence that justifies the Public Prosecutor’s Office filing a complaint. The seriousness of the case is corroborated by the fact that, two years before the opening of the investigation, the PGR was already aware of the facts attributed to the applicant, based on the employee’s report. Even worse, as shown in the documents attached to the case by the defense, there is still no indication of the outcome of the case”, he added.
