Lula sanctions regulation of bioinput production

Law determines fiscal incentives, export support and training of professionals for technical assistance in the area

The regulation of oil production in Brazil was sanctioned by the president (PT). The decision was published in DOU (Official Gazette of the Union) this Tuesday (Dec 24, 2024). Here is it (PDF – 364 kB).

According to the new legislation, the inspection and control of bioinputs will be the responsibility of agricultural defense bodies at federal, state or district levels.

The Trepda (Establishment and Agricultural Defense Product Registration Fee) was instituted for registrations that require technical analysis. Prices range from R$350 to R$3,500.

The law also establishes fiscal and tax incentives to encourage production and research, with priority for small producers, cooperatives and family farmers.

ON-FARM PRODUCTION

One of the main concerns raised by the (Agricultural Parliamentary Front), the text resolves a conflict of legislation on bioinputs on-farmthose manufactured directly on rural properties, allowing production for own use with simplified standards.

Thus, bio-inputs intended for personal use are exempt from registration, as long as they comply with good practices. These products cannot be sold.

EXPORT

To increase Brazil’s competitiveness in the foreign bioinput market, products intended exclusively for export may be exempt from registration, requiring only prior communication. The measure aims to facilitate access to new markets and strengthen Brazil’s presence on the international scene.
