Minister Flávio Dino, of the Federal Supreme Court, denied one from the Novo Party to block transfers from the Lula government to Health, classified as mandatory expenditure – which, according to the party, were being used “improperly in order to compensate for parliamentary losses resulting from the suspension” of rapporteur and committee amendments – secret budget assets.
The request was to suspend the commitment, settlement and payment of funds for the Population Health Care Program for Medium and High Complexity Procedures, and the Primary Health Care Floor. Novo wanted the transfers to be suspended until “due clarification ” by the Secretariat of Institutional Relations of the Presidency of the Republic and the Ministry of Health.
The caption also asked that the Federal Police be asked to investigate the case, to “investigate possible criminal practices related to the deliberate circumvention of decisions” of the STF – in this case, the overturning of the secret budget.

Dino denied the suspension, arguing that the request had been made in the context of the action that analyzes, in the STF, the validity of the Pix amendments. The minister stressed that Novo questioned the execution of the Executive’s own headings, “which have their own constitutional, legal and regulatory rules”.
According to the order, Novo must file a separate action to question the transfers, as they are “new facts distinct from the controversies over parliamentary amendments – individual or collective – to the General Budget of the Union”.
Novo sued Dino under the argument of “strong signs of misuse and fraud” regarding the STF decision that overturned the secret budget.

“The evidence points to the use of funds that do not comply with their mandatory nature, distorting their original purpose in favor of political interests and to the detriment of the principle of impersonality. The continuity of such practices compromises the effectiveness of the decisions previously handed down by this Federal Supreme Court, in addition to configuring a serious violation of the legal system and potential harm to the public interest”, maintains the party.
