The São Paulo Court exempted the former coach (PRTB) from paying US$ 1 million to Francisco Luciano da Silva Sales, which was fulfilling a promise made by the former candidate for Mayor of São Paulo in March last year.
On the occasion, during a live interview with the “Pânico” program, on Young PanMarçal promised to pay the amount to anyone who found a lawsuit filed by him, “against someone” for “anything”, regardless of whether they were an individual or legal entity.
Sales was one of at least four people who went to court requesting payment as per Marçal’s promise. The former coach’s defense claims that the statement was made in a humorous context, without the intention of establishing a legal commitment, and that it was revoked after the program.
Judge Giuliana Casalenuovo Brizzi Herculian, responsible for the sentence handed down this Sunday, the 19th, understood that the promise did not generate a legal obligation and that it could not be taken seriously due to the “jocular tone” in which it was made.
“Contrary to what the plaintiff would have you believe, there is no way to frame the defendant’s statement as a promise of reward, consequently not imposing any legal obligation”, says an excerpt from the decision. The judge also argues that, to have legal validity, the promise needs to be publicized.
There was an attempt at conciliation in the process, carried out in July last year, but it was unsuccessful. According to the decision, Sales must pay the costs and expenses of the case, as well as the defendant’s lawyer’s fees, set at 10% of the value of the case, or R$100,000. He can appeal.

As shown by the EstadãoIn April 2023, lawyer César Crisóstomo filed a lawsuit charging just over R$51 million for Marçal’s promise. Crisóstomo said he had found at least 10 lawsuits filed by Marçal in recent years. At the time, the former coach called the attitude “the height of failure”.
