Quotas, criminal age and abortion are CCJ guidelines this year

There are 32 propositions that can already be voted in the board; Almost 60% of them are under the report of the opposition

A (Senate Constitution and Justice Commission) Begins activities in February with controversial bills in line. Among the 32 propositions that can already be voted in the collegiate are topics such as abortion, quotas, reduction of the age of criminality and reduction of protected area in the Amazon.

Almost 60% of the propositions are under the report of opposition senators. This is the case, for example, of the PDL (Legislative Decree Project) intended to convene plebiscite for voters to decide on abortion, when answering the question “Should abortion be legalized in Brazil?”.

The bill was initially proposed by the senator (PL-RN) and signed by 45 other senators, not only of the opposition. The senator (PL-ES) explains in its report that the referendum is called before a project is approved for the population to comment.

“It is a form of consultation formulated to the people to deliberate on matters of marked relevance, of a constitutional, legislative or administrative nature”says in the report.

In mid -2024, the theme was the subject of controversy due to a bill analyzed in the House of Representatives that equates the abortion in gestation over 22 weeks with murder (PL )

The decision to guide the projects to be voted on is the president of the CCJ. The current president, the senator (Brazil-AP Union), now the 2-year term ends. In February, the senators should elect the new Senate President and, later, the presidents of the commissions, after nomination of the leaders.

Gender

O PL from the senator (PT-ES), seeks to allow the registration of two mothers, 2 fathers or only 1 of 2 in citizens’ certificates and records. The proposition received support from the senator’s report (MDB-SE).

According to Contarato, “The family entity can be formed by homosexual union”and denying the inscription of these parents is a form of discrimination.

Already the PL from the senator (PL-SC), prohibits the use of so-called neutral language in educational establishments, whether public or private. This form of communication removes the male and feminine genres from words to “Express the point of view of people who do not feel represented”but create arbitrariness and difficulty learning the cultured norm of language, according to Seif.

The approval of the proposal would validate decisions from other states, such as Amazonas, which approved in 2023 state law to prohibit neutral language. But the norm was later overthrown by the Supreme Court (STF), which considered to be the attribution of the Union to legislate on the matter.

Criminal majority

PEC (Proposal for Amendment to the Constitution) first presented by the senator (PL-RJ), reduces from 18 to 16 years the age at which a person can answer for crimes. According to the senator, one of the effects will be the reduction of the enticement of minors for organized crime.

The senator recognizes that the subject “It causes a polarization in the speeches, without achieving a common denominator for the issue”. The Senator’s report (Brazil-AC Union) It removes from the text the prediction that less than 14 could respond criminally when it comes to crimes related to heinous crimes and criminal organization.

Electoral Code and Quotas

The project of the New Electoral Code (PLP ) can be voted in the first quarter of this year, according to the rapporteur of the matter, senator (MDB-PI). The text is composed of 205 pages, which seek to consolidate in almost 900 articles to electoral legislation – then contemplated in several rules, including the current Electoral Code and resolutions of (Superior Electoral Court).

Among the changes, the text establishes quotas of 20% of chairs in the federal, state and municipal legislatures for female candidacies and 30% electoral candidacies by gender (in the case of proportional election).
