The Attorney General of the Republic, Paulo Gonetis finalizing the complaint against the former president Jair Bolsonaro (PL) and can ask for a penalty of up to 28 years in prison, according to information published by the column of journalist Monica Bergamo, in S.Paulo Folha on the night of Thursday (13). The complaint, according to the report, must be presented before the carnival.
According to the newspaper, the play should initially aim at the accusation that Bolsonaro led a criminal organization with the aim of giving a coup in Brazil. Other investigations, such as those related to jewelry and fraud in vaccine cards, should be treated separately in a second moment.
The complaint is based on the Federal Police report (PF), which concluded that Bolsonaro joined and led a criminal organization aimed at trying to prevent the possession and exercise of power of the elected government.

According to the PF, Bolsonaro was indicted in three different articles, with penalties that added to 28 years in prison in case of maximum conviction. The crimes attributed to the former president are:
- Article 2 of Law 12.850/2013: Integrate, promote or finance criminal organization (penalty of 3 to 8 years in prison).
- Article 359-L of the Penal Code: Try to abolish the Democratic Rule of Law through violence or serious threat (a penalty of 4 to 8 years).
- Article 359-M of the Penal Code: Try to testify, through violence or serious threat, a legitimately constituted government (a penalty of 4 to 12 years).
If PGR asks the minimum penalties, Bolsonaro could be sentenced to 11 years in prison. However, Monica Bergamo states that the former president’s allies believe that Gonet will request more severe punishments, taking into account that others involved in the acts of 8 January have been sentenced to up to 17 years in prison.
