Arrested since November 2024, military is investigated for having, in the PF’s understanding, plotted to kill Lula and Moraes
The defense of the Mario Fernandes reserve general, denounced by state by the PGR (Attorney General’s Office), requested on Thursday (6.mar.2025) that the case be tried in the 1st degree of justice. The lawyers question the jurisdiction of the (Federal Supreme Court) to judge the case, stating that Fernandes has no privileged forum.
In November, court minister Alexandre de Moraes ordered the arrest of the general and 4 more people in the process investigating a plan to kill the president (PT), the vice president (PSB) and the minister himself. The petition of Fernandes’s defense was sent to the Supreme.
According to the lawyers, the judgment of the case should be carried out in the lower court. They also say that Mario Fernandes did not have full access to the file for not being able to access a computer in prison.
“It should be noted that the defense did not claim to leave electronic equipment with the applicant [Mário Fernandes]but only computer entry so that, in the visits, lawyers can discuss the facts and documents with the applicant ”read in the document.
“With the maximum respect, it prevents the defense of entering laptop in the visit between professional and denounced, aiming to discuss with the Applicant everything that matters to its defense, in view of how the file is presented (completely electronic), results in a prominent contradiction with a means used by the judiciary itself, when submitting the complaint to the accused by digital and imposes. Impossible to build with the applicant against argumentation to the prosecution without being able to see with his own eyes the elements of information contained in the electronic records, allowing him to tread the contradictory and broad defense ”.says the petition.
Mario Fernandes served in the office of former Minister of Health and Federal Deputy (PL-RJ) from 2023 to March 2024. The reserve general was also a substitute head of the General Secretariat of the Presidency of the (PL) Presidency from October 2020 to January 2023.
According to the Federal Police, “Mário Fernandes, acting in a context of wide capillarity, promoted planning, coordination and execution of undemocratic acts, including frequency records to camp assembled in the surroundings of QGEX, and even direct relationship with radical protesters who acted in the post-election period of 2022”.
