Justice condemns Marçal to indemnify Boulos at $ 30,000 for speech in podcast

Businessman and influencer Pablo Marçal (PRTB) was ordered to pay R $ 30,000 to federal deputy Guilherme Boulos (PSOL-SP) for repair of moral damages.

Both were opponents in the electoral race for the São Paulo City Hall in the 2024 election and were defeated by Ricardo Nunes (MDB).

The decision, of the 9th Civil Court of the Court of Justice of the State of São Paulo (TJ-SP), refers to a speech of Marçal in a podcast, when he said that Boulos “invades ownership of others, puts families there and still charges rent”.

Transmitted eight months ago, the episode with the businessman has more than two million views on Youtube.

“Boulos, no one knows, but I will reveal this in this campaign, he is the largest irregular real estate in the state of São Paulo. He puts the family there can
Ask families, I went, I’m going to everything (sic) charges $ 700.00 for rent of these people, ”said Marçal, citing that what he called the rental of people vulnerable by the PSOL parliamentarian is the“ largest real estate system ”seen in the city of São Paulo.

According to Judge Anderson Cortez Mendes, responsible for the case, the entrepreneur “merely claimed that he did not exceed the limits of freedom of expression and political criticism, when instigated by the interviewers, without, however, gathering any evidence quite to demonstrate that imputation was true.”

The favorable decision on Boulos, however, was partial – the court denied the deputy’s defense request to exclude the episode with Marçal from the “The Podcast Partners” on YouTube.

In addition to the $ 30,000, Marçal will have to remove the posts that sell the interview from her social networks, such as Instagram, Facebook, X (former Twitter) and Tiktok.

Otherwise, it can be a fine of R $ 1,000 per business day from the subpoena, with limitation of R $ 50 thousand. The same amount of $ 50,000 will be added if he posts the content again.

Sought by CNN, Pablo Marçal’s team said the businessman will appeal the decision.
