Minister André Mendonça of the Federal Supreme Court (STF) determined to the Federal Police to repeat testimonials from the investigation in which the former minister is accused of sexual harassment.
The decision complies with Almeida’s own request, who argued that the defense were not recorded in audio and video, unlike others previously taken.
“Audiovisual recording provides scrutiny as inquiries are made, whether in full or not, with full exemption, without which the instruction of the deed is conspreded, being the right to be unambiguous that the statements were faithfully incorporated into the accurate notebook as made,” said the former minister’s lawyers on April 15.
On the same day, Mendonça, rapporteur of the case, agreed with the request. “The defense is right when it states that, in the harvests of the first testimonials of the investigation, there was the full audience of the hearings,” said the minister.
He advised the PF that he recorded future testimonials and repeats the previous ones, recording them in video. But preserved the hearings already performed and determined that they are not despised.
The inquiry was opened last year, after complaints that Almeida would have harassed the minister, of racial equality, his then colleague of government. The former Human Rights Minister denies the accusations.
Sought, the defense of the former minister declined to comment.
“Regarding the news published on the procedure adopted in the police inquiry, the defense of Silvio Almeida informs that it is a confidential investigation, which is why it is only pronounced in the case file,” he said.
The lawyers added that “the broad defense, contradictory and the parity of weapons are unenforceable rights and guarantees, guaranteed by the Constitution and the law of the country to every citizen, whose compliance is mandatory in any investigation.”
