Minister Alexandre de Moraes of the Federal Supreme Court (STF) determined on Thursday (19) that the Supreme Police Authority investigate Judge Lourenço Miglioorini Fonseca Ribeiro, from the Uberlândia Criminal Execution Court (MG), who released the mechanic Antônio Claudio Alves Ferreira, sentenced to 17 years in prison by the acts of January 8, 2023.
According to Moraes, who on the same day decided to revoke the freedom granted by the Court of Minas Gerais (TJ-MG), the Court acted outside its competence, and released the defendant before it allows the law.
“Judge Lourenço Miglioni Fonseca Ribeiro, from the Uberlândia District Court of Criminal Executions/MG, made a decision outside the scope of his competence, and there is no decision of this supreme cut that has attributed the jurisdiction to any measure except the mere issuance of the penalty certificate,” said Moraes.
“The defendant is primary and was convicted of crimes committed with violence and serious threat, so that his transfer to the semi -open regime could only be determined – and exclusively by this supreme cut – when the prisoner had served at least 25% of the sentence,” Moraes continued in the warrant of the new prison.
On Monday (16), the TJ-MG issued detainee release permit. The judge understood that the convict already fits the progression of closed regime for the semi -open.
In the decision, the magistrate explained that the release of Antonio would be without an electronic anklet due to the lack of equipment in the state. Antonio was trapped for almost a year and a half for the breaking of Balthazar Martinot’s historical clock in the Planalto Palace.

Balthazar Martinot’s historical clock was a gift from the French court to Dom João VI. The rare piece is part of the presidency collection.
The relic was destroyed by Antonio, who was filmed by committing the act during the invasion of the Planalto Palace in Brasilia on January 8, 2023.
