Any intentional omissions do not cause nullity of the denunciation, says Moares

The minister do dismissed on Tuesday (9) questions made by the defenses of the defendants of the attempted on the award-winning denunciation of Lieutenant Colonel Mauro Cid. Moraes argued that there is no contradiction in CID’s testimonies and stressed that “any intentional omissions do not cause nullity of the denunciation, the information, but there is necessary later analysis of total or partial effectiveness and modulation of the agreed benefits”.

Moraes voted to maintain the full validity and regularity of the denunciation and stressed that the voluntarity of the agreement “was widely debated” in the trial that made defendants Bolsonaro and his allies, as well as the “absence of improper participation” of the rapporteur in the agreement. The rapporteur also argued that there is no addiction to the fact that the agreement was signed between the Federal Police and the employee. He pointed out that the collaboration is a means of obtaining proof and recalled that the Attorney General’s Office, at first, was contrary to the agreement, but then changed its position. Thus, the assessment was that the allegation of the violation of the clauses of the denunciation agreement should not prosper.

The minister also countered arguments from the defenses that Cid would have granted eight contradictory allegations. “Ear verification of bad faith litigation to say that the first testimonials were contradictory allegations. Or Beira total ignorance of the case,” he said. According to Moraes, by research strategy, the Federal Police decided to fractionate Cid’s testimonials, rather than reaping a single major testimony, because they deal with eight different facts. In this context, the minister remembered other episodes that weigh against Bolsonaro, such as jewelry, vaccination.

The minister also indicated that the audios attributed to Mauro Cid and used by the defenses to contest the denunciation do not affect the information of the denunciation and did not imply damage to the defenses. Moraes also pointed out that the veracity of the audios is being investigated and recalled that the defenses had the opportunity to contest, point to point, the questions presented in the denunciation.
