Flávio Dino Minister voted on Tuesday (9/9) for the conviction of former President Jair Bolsonaro (PL) and allies for involvement in the alleged coup plot that intended to prevent the inauguration of President Luiz Inacio Lula da Silva (PT).
Dino accompanied the opinion of the Attorney General’s Office (PGR) favorable to the conviction of the defendants. The minister followed the vote of colleague Alexandre de Moraes, who also positioned himself for the conviction of the former president and the other 7 accused of core 1.
With the vote, the trial is 2-0 for the conviction of the former president. The two ministers also voted for Alexandre Ramagem’s conviction, Almir Garnier, Anderson Torres, Augusto Heleno, Mauro Cid, Paulo Sérgio Nogueira and Walter Braga Netto.

Crimes imputed by the PGR and analyzed by the ministers:
- Armed criminal organization.
- Attempted violent abolition of the Democratic Rule of Law.
- Coup d’etat
- Damage qualified by violence and serious threat against the union’s assets, with considerable damage to the victim (except branch).
- Detioration of listed heritage (except branch).
The crimes attributed to Alexandre Ramagem – deterioration of overturned assets and qualified damage – were suspended because they occurred after the diploma, partially meeting the request of the House of Representatives.

- Alexandre Ramagem: Former ABIN director, he is accused by the PGR of acting on the dissemination of fake news about election fraud.
- ALMIR GARNIER SANTOS: Former Navy Commander, he would have supported the attempted coup in a meeting with commanders of the Armed Forces, in which the then Minister of Defense presented a draft of coup decree. According to the PGR, the admiral would have made Navy troops available.
- Anderson Torres: Former Justice Minister, he is accused of legally advising Bolsonaro in the execution of the coup plan. One of the main indications is the draft of the coup at Torres’s house in January 2023.
- Augusto Heleno: Former GSI minister, the general participated in a live that, according to the complaint, propagated false news about the electoral system. The PF also located an agenda with annotations on the planning to disbelief the electronic ballot boxes.
- Jair Bolsonaro: Former President of the Republic, he is appointed as leader of the coup plot. The PGR maintains that Bolsonaro has commanded the plan to stay in power after being defeated in the elections and, therefore, responds to the qualifier to lead the group.
- Mauro Cid: former assistant of orders from Bolsonaro and the whistleblower of the case. According to PGR, he attended meetings about the coup and exchanged messages with content related to action planning.
- Paulo Sérgio Nogueira: Former Defense Minister, he reportedly presented to the Military Commanders Defense Defense, written by Bolsonaro. The text provided for the creation of a “electoral regularity commission” and sought to nullify the outcome of the elections.
- Walter Souza Braga Netto: It is the only defendant arrested among the eight accused of the central nucleus. Former Minister and General of Reserve, he was arrested in December last year on suspicion of obstructing investigations. According to Cid’s denunciation, Braga Netto would have delivered money in a wine bag to finance camps and actions that included a plan to kill Minister Alexandre de Moraes.
Alexandre Ramagem is the only one who only accounts for three crimes due to a decision of the STF. After request of the House of Representatives, two crimes were upheld from the analysis because they were committed after the parliamentarian’s election. Ramage is responsible for criminal organization, attempted violent abolition of the Democratic Rule of Law and coup.
