The São Paulo Court rejected a criminal complaint filed by striker Dudu against Leila Pereira, president of Palmeiras. Atletico-MG striker had alleged injury and defamation after statements by the leader.

In a decision published last Friday (19), Judge Érica Aparecida Ribeiro Lopes and Navarro Rodrigues, from the 13th Criminal Court, assessed that there was no crime against honor.

In the action, Dudu pointed out some phrases said by Leila on January 13, January 17 and May 9 and asked her to be framed in Articles 139 and 140 of the Penal Code.

On one of the occasions cited by Dudu, Leila said, “What I don’t forget is the damage he gave to Palmeiras.”

In the ruling, the judge stated that “in relation to the statements made on January 13 and January 17, it is clear that his statements concern a conflict much more about issues related to the termination of the athlete’s employment contract with the sports society than the moral offenses itself.”

On May 9, President Alviverde said, “I don’t usually talk about athletes other than Palmeiras.” He also said, “You know I have an action for the offenses he committed against me, I won’t talk about this athlete.” Finally, he stated, “I hope justice see very carefully and attention to this problem that I have suffered, and that we women suffer daily, these offenses and humiliations.”

“From the careful reading of the highlighted stretch and other statements of equal content, it is seen that the will only express its indignation against a specific episode, that is, it does not mention any other action of the defendant against other women, or other conduct of him, that could attribute to misogyny, that is, a widespread hatred of all women and all their facets of behavior,” says the decision.

In July, Dudu was punished by the Supreme Court (STJD) because of offensive posts against Leila Pereira. The player was denounced based on article 243-G of the CBJD (Brazilian Code of Sports Justice), which provides for punishment to those who practice discriminatory act. In this case, discrimination against a woman. The penalty provided for in the article ranges from five to ten hook games.
