The defense of the former barefoot of the Banská Bystrica underworld of Mikuláš Černák speaks of fulfilling the conditions for his conditional release from prison. The prosecutor of the District Prosecutor’s Office Trnava Monika Brodanská proposes to the court to leave Černák in prison. The prosecutor underlined that the civic association Restart-Novi Life, except Černák, has not given any other proposal for conditional release of the convicted person. According to her, the activities of the association are aimed at “diametrically in a different direction”. According to her, the Association has only recently added assistance to the convicts to the convicts. She spoke of purpose. “I consider it necessary that the Trnava District Court does not comply with the Association’s proposal and dismiss it,” She stressed Brodanská.
It also proposes to reject the proposal for the conditional release filed by the convicted person. In her opinion, she appealed to expert evidence, which she said, among other things, points to aggressive impulses and efforts to manipulate the convicted person. “By examining the individual judgments, it is undoubtedly obvious that he was murdered by 28 people, he made most of the murders himself,” Pototkla. She talked about the insidious way of action with an extraordinary degree of brutality and aggression. “It was executions,” she added. The behavior of Černák in the execution of punishment is considered to be purposeful, related to the effort to be conditionally released.
According to Černáková, the Senate of the Trnava District Court carried out extensive and sufficient evidence. “The convicted Mikuláš Černák has fulfilled all the formal and material conditions for conditional release,” Lawyer Diana Messinger emphasized. It considers that all the conditions are also met for the court to receive the guarantee of the civic association Restart-Nomin. In her words, expert evidence shows that after the eventual release of Černák from prison, there is no risk of re -committing crime. She added that the convicted person would not suffer and never suffered from a mental illness. She declared that in the case of conditional release, professional psychological care for Černák is also provided.
The proposal for the conditional release of Černák from prison was filed by the civic association Restart-Nomin Life. Last year, Černák asked to decide on the proposal for release so that it is also his personal proposal. He re -regretted the deeds. The former BOS Banská Bystrica underworld is serving a lifelong sentence of imprisonment for the execution and participation in several murders. Conditions for life sentences may, after 25 years in prison, apply for conditional release.
