PEC will leave Bolsonaro only 1 year and 7 months stuck at home

Former President gave his party green light, the PL, move on and approve a proposal that will also free all those who have been arrested because of January 8; In the STF, Alexandre de Moraes retreated because of magnitsky against women

Former President Jair Bolsonaro gave his party green signal, the PL, support the amnesty PEC (also called the Dosymry PEC), according to the Poder360. From what will be presented for a vote in the House Plenary, Bolsonaro’s total penalty will fall from more than 27 years to 1 year and 7 months in house arrest. With this penalty, Bolsonaro will remain ineligible and will not be able to dispute the election of 2026.

The proposal that is under discussion will reduce the penalties to various crimes imputed to Bolsonaro and other accused – this has been called the dosimetry PEC. In addition, there will be a device that will prevent the overlapping of penalties for correlated crimes in the same process.

All prisoners convicted of January 8 will be able to go home and will no longer be sorry to serve as soon as the Amnesty PEC is promulgated.

By the accounts of deputies who take care of negotiations, there are 144 January prisoners in prisons, 44 people serving house arrest and about 500 considered fugitives – they had to comply with some type of restriction (use of anklet or house arrest) and disrespected the measures. Everyone will be free with the amnesty PEC.

In the Federal Supreme Court there was a certain retreat at this time by Minister Alexandre de Moraes. He was annoyed by the last US government onslaught, which applied sanctions of the magnitsky law against his wife, lawyer Viviane Barci, and against the family company, the Lex Institute. Moraes himself had already been framed in magnitsky.

The biggest obstacle at the moment is the attacks of Deputy Eduardo Bolsonaro (PL-SP), who operates from the United States for the US government to impose more sanctions against Brazilian authorities. Within the Supreme Court, Minister Gilmar Mendes has the mission of convincing Moraes not to oppose the Amnesty PEC, which will basically reduce the penalties for the crimes for which Bolsonaro and others were convicted.

It is necessary that in the Supreme Court most of the 11 ministers will not oppose what is approved in Congress. Only then will the constitutional amendment be guaranteed will not later be annulled in the Supreme.

The former president is already under house arrest. If the PEC is approved, its lawyers will have to enter petitions requiring the reduction of the sentence and the possibility of continuing to serve the sentence at home because of its health status – to date on the effects of the stab wound on which it was targeted on September 6, 2018.

From what is being agreed, when Bolsonaro’s defense enters the postpell requests of amnesty, there will be a majority of ministers favorable to the requirements.

In Congress, although several parties such as the PL still support in public that only accept a wide, general and unrestricted amnesty, behind the scenes everything is practically resolved – all because Bolsonaro has already given the green light for a penalty reduction that results for it in less than 2 years in house arrest, which is where it is already.
