TCU discusses renegotiation of Brasilia Airport

Vital Minister of Rêgo highlights contractual balance to expand international flights and avoid increasing costs

The (Federal Court of Audit) held on Tuesday (23.SET.2025) a panel of the Consensual Solution Committee on the concession of (President Juscelino Kubitschek).

At the opening of the panel, the president of TCU, minister, defended the technical and mediator role of the Court in the discussions, highlighting the importance of ensuring contractual balance, legal certainty and quality of services.

“This we want to guarantee during this consensual solution that involves the provision of services of a very important air network such as Brasilia coordinates, a true national hub”he said.

Vital do Rêgo defended solutions built from dialogue and collaboration, citing mandatory investment alternatives aimed at capacity and service level, focused on the comfort of users and regional airports, aligned with the public aviation policy.

Expansion of international flights

The president of (Brazilian Airline Association), assessed the proposals discussed on the renegotiation of the Brasilia Airport contract. For him, all companies agree to expand the airport’s international operating area, as they see potential in this market from the federal capital.

“If it were to bring a single investment, I think all airlines would have said the international area, because we see the ability to operate more flights from here. It is today, within the operation, what we would indicate as a suggestion of investment. Companies are looking at the international operation from Brasilia.”he said during the panel.

Noman also pointed out that, in the companies’s view, Brasilia Airport has one of the best dealers in the country.

“Inframérica operates a very important asset for us, is the third airport in domestic aviation and the fourth in international, is indeed very sensitive to the entire air network in the country. It is one of the most efficient airports today. It is an airport always very attentive to the operation.”he said.

Investments without increasing costs

The president of Abear stated that any investment in the renegotiation of the contract should avoid increased costs for the sector. According to him, it is essential to expand the inclusion of class C in aviation and strengthen regional aviation.

“The population is growing, so it is natural that we beat passenger transport records. But the absolute number of passengers can hide some challenges and one of them is an inclusive growth of aviation. We are carrying more, but concentrated in large centers.”he said.

Juliano Noman also cited some for the sector, such as the IOF (Tax on Financial Operations) (which rose from 0.38% to 3.5%), the Income Tax leasing (0% until 2023 and will reach 15% in 2027) and tax reform, which can triple aviation costs.

In addition, the sector questions the Dolarization of QAV (Aviation kerosene), whose national production represents about 20% of the total.

Brasilia Airport was auctioned in 2012, during the government (PT), to meet the demand of the World Cup and the Olympics. However, the terminal never reached the number of estimated passengers.

In the first year of concession, the expectation was 17 million passengers, but the airport received 15.8 million. The situation worsened with the departure of Avianca in 2019 (responsible for about 15% of flights in the capital) and with the pandemic, when the airport even operated with only 4% of capacity at times.

Given the crisis, infummeric, government and TCU chose to seek a consensual solution through the Court’s Secretariat that discusses public concessions with difficulties in contractual execution.
