Moraes denies former TSE advisor’s request for notification in Italy and maintains summons by notice

The minister from , denied the request from the defense of the former advisor to the Superior Electoral Court (TSE) Eduardo Tagliaferro to be notified of an investigation via letter rogatory in Italy, where he currently resides. The decision was published this Thursday, 9.
With the rejection, Moraes maintained the summons by notice, a procedure used when it is not possible to locate the part of the process at the declared addresses, with the notification being published in the Official Gazette and in newspapers. The letter rogatory, in turn, is a request for the Court of another country to carry out a specific procedural act.

In his decision, the minister argued that Tagliaferro “created difficulties in being notified”, which justifies the summons by notice. “The accused is outside the national territory precisely to reiterate the criminal practice and avoid possible judicial liability. This fact is expressly confessed by the posts made by the accused on social networks”, wrote Moraes.

Tagliaferro’s defense also requested access to copies of all court orders against him, including arrest orders, freezing of assets and extradition. Moraes denied the request, stating that the process is public and that the former advisor’s lawyers are “duly qualified”. The former advisor was denounced by the Attorney General’s Office (PGR) on charges of leaking messages exchanged between STF and TSE servers. The leaked content included requests to monitor social networks and produce reports for digital militia and fake news inquiries, both led by Minister Moraes.

The crimes accused of Tagliaferro are violation of functional secrecy, coercion during the process, obstruction of investigation into a criminal organization and attempted violent abolition of the Democratic Rule of Law.
Tagliaferro is the subject of an extradition request. On Monday, the 6th, he participated in a hearing at the Italian Court and, through his social networks, he reported that he was well received by the judge and that the hearing was “fantastic”.
