The Court of Justice fully suspended the decree of the governor (Republicans) that had determined the dismissal of lieutenant Henrique Velozo, accused of killing world jiu-jitsu champion Leandro Lo in 2022. The preliminary decision, signed by judge Ricardo Dip, guarantees the reinstatement of the military police officer to the corporation’s staff and the reinstatement of payment of his salaries until the case becomes final and unappealable – when there is a definitive decision without the possibility of appeals.

With the injunction, Lieutenant Velozo once again has his functional status recognized, although he remains in custody at the Romão Gomes Military Prison. For lawyer Cláudio Dalledone, the decision reestablishes the legal balance of the case. “From the beginning, we warned that the dismissal represented an early punishment without legal support. No one can be punished before the trial”, he stated.

In another decision, also favorable to the PM, the Court revoked the transfer of the police officer from the Romão Gomes military prison to a common prison. The injunction, signed by judge Marco Antônio Pinheiro Machado Cogan, of the 5th Jury Court of São Paulo, responded to a request from the PM’s defense, who argued that the transfer could violate the principle of presumption of innocence and put the physical and psychological integrity of the accused at risk.

According to the firm Dalledone & Advogados Associados, responsible for the defense, the magistrate fully accepted the arguments presented, determining that the police officer remain in the prison unit where he is currently located.

On appeal, the defense maintained that there is no legal basis for the transfer, since the process is still ongoing and there is no definitive conviction. “As we had already warned, the transfer would put Velozo’s life in danger. The assertive decision reinforces the Justice’s commitment to due process and the protection of individual rights”, said lawyer Cláudio Dalledone Júnior.
