Agent Rui G. killed a burglar, inside his own house, after falling into a sexual trap. He has now been sentenced to 14 years in prison. The court considers that the police officer’s conduct was disproportionate to the threat.
This happened on April 1, 2024. On that day, the police Rui G. planned a sexual encounter with an alleged prostitute, who was with her alleged pimp. After all, it was just a scheme to extort money.
As reported by , the agent was forced to go to his own home, in Benfica (Lisbon), with the robbers. It was there that ended up killing one of the suspects with his service weapon.
In the ruling of October 7, to which the morning newspaper had access, the judges condemned the police officer to 14 years in prison and to pay 40 thousand euros to the victim’s son.
The kidnapper’s accomplice, in turn, received a suspended sentence of three and a half years.
In the ruling, cited by JN, the judges state that, at the moment the police officer shot the victim, there was no “current aggression” underway that would justify self-defense.
Furthermore, the agent, as he is “endowed with special theoretical, practical and physical preparation to combat aggression”, “contrary to what he wanted to make believe” to the Lisbon Court, he could have neutralized the assailant by other means or, if he used a weapon, he should have targeted non-vital areas.
The court considered that there are no circumstances that justify a special mitigation of the sentence, since there was a “glaring disproportion” between the conduct of the victim and that of the accused police officer.
Furthermore, the culprit presented an “exculpatory and victimizing speech”, without never having expressed sincere regret or self-reproach.
