After an agreement, the millions of liters seized will be disposed of. The agreement between the Federal Revenue and ICL (Legal Fuel Institute) It will correctly dispose of the material, avoiding logistical and environmental risks.
The partnership transfers to ICL – an entity that represents distributors and legal companies in the sector – the responsibility of identifying companies to store the seized fuel.
With this responsibility, these companies will give appropriate destination to loads. The objective is to prevent product deterioration, as fuels lose their characteristics over time.
According to ICL, the partner avoids environmental problems by maintaining million liters of fuel stopped and at risk of inadequate storage and consequent deterioration.
The first major challenge of the partnership involves the immediate management of fuel seized from four Refit ships, which is considered the largest persistent debtor in Brazil. The company’s stock includes gasoline, diesel and naphtha.
The initiative for the partnership came from the Federal Revenue itself, which approached the Institute to ensure that the seized product was not lost, while the legal process of the fined company continued.
In this process, ICL will mediate the search for a legal company that can take care of the legal and physical custody of the seized fuel.
When the legal process at the Revenue or Court is closed, the fuel is returned in accordance with the decision.
If the State wins, the Revenue will be entitled to the same volume and characteristics of fuel for subsequent auction. And, thus, the fuel will be returned by the company that had custody during the process. If the assessed company wins the legal dispute, the right returns to the company itself.
Emerson Kapaz, president of ICL, assesses that the agreement is a “watershed” in the fight against illegality.
“This is a historic recognition of the work that ICL and its associates have been doing. The Federal Revenue is entrusting us with a gigantic responsibility, which unequivocally signals that we will be ready to cooperate as allies of the State in the fight against crime and in the defense of a fair market”, he stated.
