The Federal Public Defender’s Office () requested this Wednesday (22) that the deputy (PL-SP) be notified by letter rogatory about the complaint filed against him in the process regarding the charging of the . However, the minister of the STF (Supreme Federal Court) rejected the request.
The request was made after Moraes ordered the DPU to assume the defense of the parliamentarian, who is in the United States and is accused of promoting the president’s government’s trade sanctions against Brazilian exports, the application of and the suspension of visas of Court ministers and members of the federal government.
For the Public Defender’s Office, before taking on the case, Eduardo must be officially informed. The parliamentarian has already been notified by notice, but has not commented. “The presentation of a response by the DPU, in the circumstances exposed, would represent a violation of due legal process, violating the defendant’s right to defense, a role that, in all evidence, cannot be assumed by the institution”, argued the body.
The letter rogatory is a longer notification procedure and must go through the diplomacies of Brazil and the United States. Furthermore, it still depends on the actions of the North American Judiciary.
The procedure was adopted in the case of another defendant, the blogger. However, the defendant has been a permanent resident of the United States for at least ten years. Eduardo left Brazil in February this year and requested a 120-day leave, which ended on July 20th. By not attending the Chamber sessions, the deputy may be impeached for absences.
