According to the federal deputy, the objective of the proposal is to reinforce discipline and the educational nature of socio-educational measures, reaffirming the authority of the State
The federal deputy (PL-MS) presented Bill No. 5,378/2025, which proposes an amendment to article 68 of Law No. 12,594/2012 — which establishes the National Socio-Educational Service System (Sinase) — to prohibit intimate visits to adolescents who are undergoing a socio-educational hospitalization measure, even in cases where they are married or live in a stable union.
The text also revokes the sole paragraph of the article, which until then allowed this exception, in order to establish the prohibition absolutely. According to Nogueira, the objective of the proposal is to reinforce discipline and the educational nature of socio-educational measures, reaffirming the authority of the State and the need for accountability proportional to the infraction committed.
“The State must make it clear that non-compliance with the laws has firm and coherent consequences. The internment measure must have an educational and disciplinary nature and cannot be trivialized”, stated the parliamentarian.
In justifying the project, the deputy cites data from the National Socio-Educational Assistance System (Sinase-2023), which indicates the existence of 11,685 adolescents in measures of restriction and deprivation of liberty in the country, and from the National Penal Information System (Sisdepen), according to which 18.1% of the prison population is in the age group of 18 to 24 years old.
For Rodolfo Nogueira, the ban on conjugal visits contributes to restoring a sense of order, responsibility and respect for norms in socio-educational units, strengthening the role of state institutions in the re-education process.
PL 5,378/2025, authored by deputy Rodolfo Nogueira, is being processed by the Deputies and will be analyzed by the competent committees before going to a vote in the Plenary.
