Chamber approves PL that creates menstrual leave of up to 2 days

The bill is aimed at workers with a formal contract, interns and domestic workers; goes to the Senate

This Tuesday (October 28, 2025) approved the PL (bill), which establishes paid leave of up to 2 consecutive days per month for women who suffer from serious symptoms related to menstrual flow. Read the proposal (PDF – 329 kB).

The congressmen voted on the text of the version of the rapporteur, deputy (PC of B-AP). Authored by the congresswoman (PC of B-RJ), the proposal goes to the Senate for analysis.

“The substitute makes a relevant contribution to Brazilian labor legislation, historically conceived under a masculine logic that little incorporated the specificities of women”said Professor Marcivania.

WHO HAS THE RIGHT TO MENSTRUAL LEAVE

To be entitled to paid leave, it is necessary to present a medical report proving the conditions that prevent the employee from carrying out activities temporarily.

The bill will apply to workers with a formal contract, interns and domestic workers.

“Each month, women of childbearing age face discomfort, to varying degrees, during their menstrual period. For most of them, this period is marked by symptoms of mild or medium intensity such as cramps, malaise, headache or migraine. But, around 15% of women face severe symptoms, with severe pain in the lower abdomen and intense cramps, which often harm their routine”says an excerpt from the project’s justification.
