The DPU (of the Union) released a note this Tuesday (28) in which it defends and criticizes police lethality after the .
In the note, the DPU recalls that the (Federal Supreme Court), in the ADPF judgment, established parameters for the actions of public security forces in favelas and determined that operations should be exceptional, justified and planned to minimize risks to the civilian population.
“Failure to comply with these guidelines represents a serious violation of fundamental precepts and compromises the effectiveness of the Democratic Rule of Law”, he states.
In the text, the Defender’s Office states that the ADPF reaffirms the State’s duty to guarantee the protection of life, human rights and dignity of people, “especially the black, poor and peripheral population — historically most affected by high lethality operations.”
The body argues that public security actions carried out by the state cannot “result in summary executions, disappearances or human rights violations, especially in communities historically marked by inequality, lack of social policies and institutional exclusion.”
Furthermore, it states that the fight against crime must occur within the limits of the law, “with proportional use of force, transparency in the investigation of facts and guarantee of due legal process, with respect for the dignity of the human person and the determinations of the Federal Constitution.”
