Minister Alexandre de Moraes, of the STF (Supreme Federal Court), determined this Thursday (30) that lieutenant colonel Mauro Cid begin serving a two-year open prison sentence.
Jair Bolsonaro’s (PL) former aide-de-camp was convicted of participating in the attempted coup d’état and signed a plea bargain, which guaranteed him the mildest sentence among the members of the so-called “crucial core” of the plot.
Moraes scheduled Cid’s admonition hearing for next Monday (3), a process in which the judge warns the convicted person about the conditions and consequences of the sentence. According to the determination, after the hearing, the lieutenant colonel will have his ankle bracelet removed.
Among those for the open regime is the prohibition on leaving Brasília without judicial authorization; home collection between 8pm and 6am and on weekends; maintenance of passport cancellation; prohibition on carrying weapons; prohibition of using social networks; and prohibition of maintaining contact with other defendants in criminal actions related to the coup attempt.
The former aide-de-camp will also have to appear at the Criminal Executions Court of the Federal District every week, always on Mondays, to inform and justify his activities.
In the decision, Moraes determined that the judicial secretariat certify the period in which Cid was provisionally detained. Time will be taken from the penalty.
With the start of the execution, the lieutenant colonel’s defense must reinforce the request for a declaration of sentence served. The lawyers argued that Cid would have already served his sentence as he had been under restrictive freedom measures for two years and five months. The period of preventive detention, however, was shorter.
The plea bargain agreement guarantees Cid the restitution of goods and valuables and the maintenance of measures by the PF (Federal Police) to guarantee the safety of the lieutenant colonel and his family.
