Moraes sends hacker Delgatti to semi-open regime – 01/12/2026 – Brasília Hoje

Minister Alexandre de Moraes, of the STF (Supreme Federal Court), granted progression to the semi-open regime, condemned by the (National Council of Justice).

(PL-SP) was convicted in the same action.

In this Monday’s decision (12), the rapporteur considered the time already served and the hacker’s behavior in the prison unit.

“In the present case, all the legal requirements required for the sentence’s progression to the semi-open regime of serving his custodial sentence are present”, said the rapporteur in the decision.

The defense asked for progression, stating that Delgatti served more than 20% of the 8 year and 3 month sentence imposed by the STF, in addition to having “excellent prison behavior, proven by a certificate and prison report”.

At the beginning of December, the PGR (Attorney General’s Office) added a report to the process confirming what was pointed out by the defense.

Delgatti and Zambelli were unanimously convicted by the First Panel of the STF for the crimes of hacking a computer device and misrepresentation.

The penalty set for Zambelli was 10 years in prison under an initial closed regime and a fine worth two thousand minimum wages. Delgatti’s sentence was set at eight years and three months in prison, also under an initial closed regime, and a fine of 480 minimum wages.

They will also have to pay compensation of R$2 million for collective material and moral damages. According to the legislation, both are ineligible from the moment of conviction until the end of a period of eight years after serving their sentence.
